Anthropic vs Pentagon: The AI Lawsuit That Could Define Industry Independence

Anthropic has filed two sworn declarations in a California federal court, pushing back on the Pentagon's assertion that the AI company poses an "unacceptable risk to national security."

The dispute began in late February when President Trump and Defense Secretary Pete Hegseth publicly announced they were cutting ties with Anthropic after the company refused to allow unrestricted military use of its AI technology.

Two key testimonies stand out in the court documents. Sarah Heck, Anthropic's Head of Policy and former National Security Council official, was personally present at the February 24 meeting where CEO Dario Amodei met with Defense Secretary Hegseth. She flatly denies the claim that Anthropic demanded an approval role over military operations.

Thiyagu Ramasamy, Anthropic's Head of Public Sector, argues that the Pentagon's concern about Anthropic potentially disabling its technology mid-operation was never raised during negotiations. It appeared for the first time in the government's court filings.

The case took an interesting turn after a confidential document was leaked to TechCrunch. The Pentagon informed Anthropic as late as one week after Trump declared the relationship over that the two sides were "nearly aligned" on terms. A hearing is scheduled for Tuesday, March 24 before Judge Rita Lin in San Francisco.

The case sets a critical precedent for the entire AI industry: Can governments force AI companies to provide unrestricted access to their technology for military purposes? The outcome could affect all major AI players including OpenAI, Google, and Meta.
