California Introduces AI Regulation for State Contracts
Governor Gavin Newsom signed Executive Order N-5-26 on April 5th, 2026, introducing new requirements for AI use in California state contracts.
The order requires companies seeking to do business with the state to document how they use artificial intelligence, which models are involved, and what measures are in place to prevent discrimination and misuse.
The purpose is twofold: to protect public safety and to ensure that AI systems used on the state's behalf do not discriminate against or harm citizens. The measure is one of the most concrete attempts by a U.S. political body to regulate AI in practice, not just on paper.
California has long been a pioneer in technology regulation, and this order may become the template for similar initiatives in other states. For vendors selling AI solutions to the public sector, this means increased requirements for transparency and documentation. For CIOs and IT leaders, it is a clear signal that the "black box" approach to AI is on its way out.
The order takes effect immediately and applies to all contracts with state agencies in California.
